Terms

The terms that apply to any work I take on.

Who you are contracting with

Smart Food Media is a trading name of Andras Dietrich, a sole trader based in Brentford, London. Any agreement for work is between you and Andras Dietrich. You can reach me at andras@smartfoodmedia.com or +44 7453 876227.

What I do

Photography, film and related content production for food and hospitality businesses. Every project is quoted individually, and the quote sets out what is included.

Quotes and booking

A quote is valid for 30 days. A booking is confirmed when you accept the quote in writing and the deposit has been paid. The date is not held until then.

Payment

A 50% deposit confirms the booking and holds the dates. Work starts once it has cleared. The deposit is not refundable, because it covers the cost of producing the work.

Projects under £1,500 are paid in full up front.

Up to £5,000, it is 50% on invoice and 50% on delivery.

From £5,000, it is 50% on invoice, 25% before the shoot day, and 25% once you have approved the samples.

Invoices are due on receipt. If your company works to 30 day terms, tell me before we start and I will put it in writing.

The balance is due before the final files are released, and the work stays mine until it is paid for.

Moving a date

Once the deposit is paid, the date is held for you. If something comes up, tell me as early as you can and I will move it wherever my calendar allows. The deposit moves with the booking. Moving a date is always easier than cancelling one, so ask.

Cancellation

I need a week’s notice before the shoot day, because that is when the studio, the kit and anyone helping on the day get booked.

The deposit is not returned. If anything has already been booked and paid for on your behalf, that is charged at cost. Any work already produced is invoiced at the stage it reached.

Copyright

I own the copyright in every photograph and film I make. That is automatic under UK law as the author, and it does not change when the invoice is paid.

What you can do with the work

The licence is agreed for each project and written into your quote. Tell me where the work is going before the shoot: the pack, the listing, the website, paid media, out of home, trade. The end use decides the licence, and it is always cheaper to agree it up front than to extend it afterwards.

Showing the work

I own the copyright, so I show my own work: portfolio, website, case studies, social. What I do not show is anything unreleased. If a product, a campaign or a site has not launched yet, it stays with me until it has.

Revisions

Two rounds of revisions on the edit are included. Sensible corrections beyond that are not something I am going to argue about.

Music and stock

Licensed music and stock elements come from my own subscriptions. If you want a specific track or asset outside that, the licence for it is at your cost.

Expenses

Travel, accommodation and subsistence outside London are charged at cost, and agreed before they are incurred.

What I need from you

Brand assets, the product, and one person on the day who can answer questions.

Paid media

Where I run ads, the budget is yours and sits on your own card in your own account. It is never part of my fee, and I never hold your card.

Liability

My liability is limited to the fee paid for the work. Nothing here limits liability for death, personal injury, or anything else that cannot be limited by law.

Governing law

These terms are governed by the law of England and Wales.
